Grounds for Divorce
The most common and popular ground (reason) to apply for divorce in New York State is Irretrievable Breakdown in Relationship between the Parties, with no hope of reconciliation, similar to "Irreconcilable Differences".
Contested Divorce
When the spouses are unable or unwilling to agree on one or more key issues to finalize the divorce, the court must now adjudicate the dispute and settle all of the outstanding matters such as property division, child support, custody, visitation, and alimony if applicable.
Uncontested Divorce
Where the spouses have amicably agreed upon and resolved all major issues such as property division, child custody, support and visitation, and do not appear in court to litigate any of these issues.
Default Divorce
When the Defendant spouse after having been served with process fails to respond to the service or ignores the deadline to respond, the Plaintiff spouse can then apply to the court for a default divorce. Proof of service of process must be submitted.
Foreign Divorce
Once certain requirements are met, a foreign divorce decree is generally recognized as valid in the US. on the basis of comity, ie. the mutual recognition by nations of laws and customs of other nations.
No-Fault Divorce
Allows on spouse to file for divorce without blaming the other spouse or indicating that it was the other spouse's fault, ie Irretrievable Breakdown in Relationship or Irreconcilable Differences.
